Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

HiveSense is an offline-first beekeeping management application that allows you to track apiaries, hives, inspections, treatments, harvests, and tasks. The App supports Bluetooth Low Energy (BLE) sensor integration, on-device voice-to-text for hands-free note-taking, and optional cloud sync for multi-device access and team collaboration.

3. User Accounts

You may use the App without creating an account for local-only functionality. To access cloud sync, organization features, and multi-device access, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access to your account

You must provide accurate and complete information when creating your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' data
• Interfere with or disrupt the App's functionality or servers
• Reverse engineer, decompile, or disassemble the App
• Use the App to transmit malicious code, spam, or harmful content
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

5. Your Data

You retain ownership of all beekeeping data, photos, voice notes, and other content you create within the App ("Your Data"). By using cloud sync features, you grant us a limited license to store, transmit, and process Your Data solely for the purpose of providing the App's functionality to you.

When you share data within an organization, other organization members may view and manage that shared data according to their assigned roles. You are responsible for the data you choose to share.

6. Intellectual Property

The App, including its design, code, graphics, logos, and trademarks, is owned by HiveSense and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

7. Third-Party Services

The App may integrate with third-party services (such as BLE sensor devices and cloud services). We are not responsible for the availability, accuracy, or content of third-party services. Your use of third-party services is subject to their respective terms and policies.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Beekeeping decisions should not be based solely on information provided by the App. The App is a management tool and does not replace professional beekeeping knowledge or veterinary advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIVESENSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless HiveSense from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately. Data stored locally on your device will remain accessible, but access to cloud sync features will be revoked.

You may stop using the App at any time. To delete your account and associated cloud data, contact us at support@hivesense.app.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HiveSense operates, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HiveSense regarding your use of the App.
